Helping at an Accident Scene: Good Samaritan Protection
Scope of Practice & Regulatory Bodies · Question from the ATI RN Leadership 2023 Proctored Exam study set
Correct answer: Good Samaritan Law
Why this is the answer
Good Samaritan laws protect healthcare providers from liability when they provide emergency care in good faith outside of a clinical setting.
The bigger concept
Good Samaritan laws protect a nurse who gives emergency care in good faith, without compensation, outside their employment setting. They do not cover on-duty care, gross negligence, or acting beyond your scope, and a nurse who begins care must not abandon the person until someone with equal or greater training takes over. HIPAA covers privacy, the Patient Self-Determination Act covers advance directives, and tort law is the branch under which negligence is decided — none protect the roadside rescuer.
